Terms of Use
1. General provisions
These terms (the “Terms”) govern the use of the StayIndexed service (the “Service”) located at stayindexed.top, which provides monitoring of the state of pages in Google's index and related analytics. The Service is provided by its administration (the “Provider”). By registering and using the Service you (the “User”) agree to these Terms in full; if you do not agree with any of their provisions, please do not use the Service.
The Service may be used by persons who have reached the age of majority (18) or are otherwise entitled to enter into contracts under the laws of Ukraine, as well as legal entities and individual entrepreneurs through their authorized representatives.
2. Description of the service
The Service allows you to add URLs for regular or one-off checks of Google indexing status, the technical availability of a page and the generation of recommendations. The check results are based on automated scanning using third-party technical means (including the API of a third-party search data provider) and may not always fully match the actual data of Google Search Console. The Provider is not a partner, representative or affiliate of Google and does not guarantee the accuracy of the displayed real state of Google indexing at any particular moment.
3. Registration and account
Access to the Service is provided exclusively through a Google account. You are responsible for keeping access to your Google account and for all actions performed under your account in the Service. StayIndexed does not store or process the password of your Google account.
4. Payment, check balance and the right of withdrawal
- A new account receives a limited number of free checks to get acquainted with the Service.
- Further checks are paid for by topping up the balance; the cost of one check depends on the top-up volume and is shown on the pricing page at the time of payment.
- Payment is accepted in Ukrainian hryvnia at the rate shown on the billing page at the time of payment.
- Funds on the balance do not expire.
- Since the Service is a digital service whose provision begins immediately after payment (tokens become available for use right away), by making a payment the User gives express consent to the start of the service before the expiry of the withdrawal period provided by consumer protection legislation, and understands that after payment the right to withdraw from the contract is lost. The conditions for refunds (in exceptional cases — an erroneous payment or a technical failure) are described in the Refund Policy.
- Charges to the balance are made upon an actually completed check in accordance with the selected frequency.
5. Limitation of liability
StayIndexed makes reasonable efforts to ensure data accuracy but does not guarantee that the indexing information is exhaustive, uninterrupted or fully consistent with Google's internal data. The Service is provided “as is”, without guarantees of uninterrupted operation. The Service is not liable for decisions made by the User on the basis of the recommendations received, nor for indirect damages, lost profit, loss of traffic or revenue related to the indexing of the User's pages. The Provider's aggregate liability to the User under any claims related to the Service is limited to the amount paid by the User over the last 3 months of using the Service.
6. Acceptable use
It is prohibited to: use the Service to check URLs that you do not own or do not have the right to manage; take actions aimed at overloading or disrupting the Service; perform automated access in a way that violates the technical limits of the API; resell access to the Service to third parties without the Provider's separate written consent; and engage in any activity that violates the laws of Ukraine or the rights of third parties. The Provider reserves the right to suspend or terminate access to an account in case of violation of this clause, notifying the User by email.
7. Intellectual property
The design, software code, the “StayIndexed” trademark and other elements of the Service are the property of the Provider or are used on lawful grounds. The User is granted a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. Data about the User's own URLs that the User adds to the Service remains the property of the User.
8. Force majeure
Neither party is liable for failure to perform obligations caused by force majeure circumstances, including failures of Google, a third-party search data provider, payment systems, a hosting provider or other technical means that are beyond the Provider's reasonable control.
9. Governing law and dispute resolution
These Terms are governed by the laws of Ukraine. Disputes related to the use of the Service are resolved through negotiations, and if no agreement is reached — in the manner established by the applicable legislation of Ukraine.
10. Changes to the terms
StayIndexed may update these terms. Users will be notified of material changes by email linked to the account no later than 7 days before they take effect.
